These Specific Terms & Conditions and the General Terms & Conditions included elsewhere on the Sites (hereafter jointly called the "General and Specific Terms & Conditions") constitute a legally binding agreement and are not only applicable to the content and Service provided via Short Messaging Service (hereafter called the "SMS service"), but also to the Service provided via the internet, this website or a WAP site ("the Sites") and/or via other methods of delivering mobile content from MYPENGO or its affiliated companies (hereafter called the "Provider", "we", "us" or "our"), unless otherwise agreed in writing. See here the general terms & conditions, which are also applicable in the Netherlands. The two methods of use, for the SMS service and the internet (including use of the Sites) are jointly called the "Service" or "Services".

COUNTRY
The Service is offered in the Untied Kingdom.

PROVIDER
The Service is offered by Mypengo, P.O. Box 297, 1200 AG, Hilversum, the Netherlands.

ACCESS TO THE SERVICE, AVAILABILITY AND AGE
The User of the Service shall be resident Of the United Kingdom and (1) be at least 18 years old and/or have permission from (one of his/her) parents and/or the paying agent to apply for and make use of the Service in this person's name and (2) in the name of this parent and/or paying agent and him/herself, to assent to be bound by the General and Specific Terms & Conditions. When you apply for the Service and/or to be a User of the Service, you recognise and confirm that you have read the General and Specific Terms & Conditions, that you have accepted them and that you satisfy the terms and conditions applicable to your situation as described above.

FEES
The applicable fees and tariffs are communicated via the Service, in the TV commercials and on the Sites. For use of the SMS Service you pay a fee corresponding to the Provider's applicable tariffs, via the phone bill issued by your mobile network provider if you have a contract; otherwise this fee is deducted from your phone credit. If, for whatever reason, you wish to terminate the Service, fees already paid cannot be refunded, unless the agreement explicitly provides for this option. Separate fees for text messages from your mobile network provider are applicable.

SHORT CODES, KEYWORDS AND URL OF THE SITES
The short codes, keywords and URL (Uniform Resource Locator) that we use for our Service and on the Sites are communicated to the User via the Service, the TV commercials and on the Sites.

CUSTOMER SERVICE AND COPYRIGHT INFORMATION SERVICE
We offer you information on the web pages relating to the Service and/or via the SMS service and/or via the TV commercials. If you would like more information or have specific questions, you can send an e-mail to our Customer Service team and/or to our copyright agent via the e-mail address you will find on the Sites or will have received via the Service. FREQUENTLY ASKED QUESTIONS:

1. How can I unsubscribe from this service?
If you want to unsubscribe from this service, you can do this very easily by sending a text message with the words STOP or STOP ALL to 85115. Another way is by calling our customer service at 020-31056051 for extra information and to stop from the service.

2. I didn't know that I have to pay for this service?
We clearly communicate, not only on our website, but also in our commercials (visually or/and verbally) what the price per message is. Furthermore after a customer subscribes he or she will also receive a welcome message. These messages contain the price information and unsubscribe information.

3. I didn't know I subscribed to a subscription service?
In all our advertisements we clearly communicate (visually or/and verbally) that this is a subscription service. We also clearly state what the price per message is.
4. I have never subscribed to this service, but I am receiving messages, how is this possible?
It is impossible that customers receive messages at random on their mobile phone. The only way to subscribe to our service is by sending a text message with the advertised keywords from the mobile phone number that receives the messages to the service. Maybe somebody else used your mobile phone to subscribe to the service. In any case we are not allowed to send any messages, before somebody actually subscribed.

5. My child subscribed to the service, can I get a refund?
This service is open for users age 16+ and we clearly state that children under 18 must seek parental approval before subscribing to any of our services. In every case, the contracting party of the mobile phone, which receives the text messages, is responsible for the mobile phone. So, we are very sorry, but in this case you don't get a refund.

6. In which cases do I get a refund?
Customers can receive a refund in two cases:
1.When there was a technical failure with the service
2. When a customer tried to unsubscribe with the right unsubscribe message and couldn't unsubscribe. Then the customer gets a refund from the date he or she tried to unsubscribe.
